Returns Policy

Terms and Conditions

These Terms and Conditions (“Terms”) govern the sale of goods and services (“Products” and “Services”) by Twenty35 IT Pty. Ltd. (“we”, “our”, “us”) to the purchaser (“you”, “your”). By purchasing from us or subscribing to our services, you agree to these Terms, which comply with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth).


1. Australian Consumer Law – Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.


2. Change of Mind Returns

Please choose carefully. We do not offer refunds or exchanges for change of mind, incorrect choice, or if you simply no longer want the item.
However, we may offer an exchange or store credit at our sole discretion and under certain conditions (e.g. item unused, in original packaging, and within 7 days of purchase). Any approved change-of-mind returns may be subject to a restocking fee.


3. Non-Refundable Items

Unless required by law, the following items are strictly non-refundable and non-returnable:

  • Custom or made-to-order products
  • Clearance or sale items
  • Opened or used items (if hygiene or health reasons apply)
  • Software licence keys and digital/downloadable products
  • Items damaged due to misuse or neglect
  • Subscription payments (unless the service fails to meet consumer guarantees)

Note: Software licence keys are considered digital goods. Once issued, they cannot be returned, refunded, or exchanged, as they are deemed “used” upon delivery.


4. Subscriptions to Services

By subscribing to our services, you agree to the following:

a) Billing and Payment
Subscriptions are billed in advance on a [monthly/annual] basis and will renew automatically unless cancelled prior to the next billing cycle.
You authorise us to charge your nominated payment method for each subscription period.

b) Cancellation
You may cancel your subscription at any time by providing written notice via email or through your account portal (if applicable).
Cancellation will take effect at the end of the current billing period. No pro-rata refunds will be issued for unused portions of a subscription period, unless required by law.

c) Free Trials
If a free trial is offered, you will be notified of the duration and the terms. You must cancel before the trial ends to avoid being charged.

d) Failure to Pay
If your payment fails, your access to the service may be suspended until payment is successfully processed. We reserve the right to cancel your subscription if payment is not received within 30 days.

e) Service Changes or Disruptions
We may modify or discontinue services with reasonable notice. If a service is discontinued during your active subscription and you are not at fault, you may be entitled to a partial refund or credit.


5. Faulty or Damaged Goods

If an item you purchased is faulty, not fit for purpose, or does not match its description, you may be entitled to a remedy under the ACL.
To request a return, please contact us by email to service@twenty35it.com.au or by telephone (02) 8313 0560 with proof of purchase and details of the issue within a reasonable time. Twenty35 IT reserves the right to decline an exchange, refund or repair where any product fault is caused by misuse or neglect.


6. Return Process

To return an item:

– Contact us first for a Return Authorisation

– Return the item in its original packaging

– Include a copy of your receipt or invoice

You are responsible for return shipping costs unless the item is faulty or incorrect.


7. Refunds (if applicable)

Approved refunds will be processed using the original method of payment within a reasonable time after inspection.
We reserve the right to refuse a refund if the returned item is damaged, used, or not in resaleable condition (unless faulty).


8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising out of or in connection with the sale or use of our products.


9. Governing Law

These Terms are governed by the laws of New South Wales (or your relevant state/territory), Australia. Any disputes will be subject to the jurisdiction of the courts of that state.

Privacy

Twenty35 IT takes the privacy of customer data seriously. Please be aware that data (including, but not limited to, images, music and video) may be lost during the repair process of electrical and electronic products. It is the responsibility of the customer to ensure that all personal data is deleted before the product is returned to Twenty35 IT.
